CIPA Field Trip!!!

To All:

As discussed in our recent meetings, there will not be a CIPA monthly meeting in February due to the fact our meeting date falls on February 14. We anticipated that some members may have a conflict with that meeting date. We are excited, however, to offer an excellent alternative to the monthly meeting!

On Saturday, February 11, we are organizing a "Field Trip" to the Abraham Lincoln Presidential Library and Museum in Springfield, IL. We anticipate two carpool meeting locations. One location in Bloomington and one in Morton. The proposed departure time will be 9 AM, and we anticipate arriving in Springfield at approximately 10:15 - 10:30 AM. We will then tour the Presidential Library & Museum. Please note the tour could take 3 - 4 hours. We are then planning on going somewhere to enjoy lunch (location TBD). Following lunch, a few of us are planning on visiting Scheels Sporting Goods in Springfield, which I understand is comparable, and possibly even more impressive, than the Bass Pro Shops.

More than 200 new laws took effect in Illinois on New Year’s Day, dealing with everything from lost pets to online bullying to seat belt use.

The laws take in a wide variety of subjects, many of which raised concerns during 2011.

Seat belt changes

Just like unrestrained front seat riders, back seat passengers who aren’t buckled up during an accident can suffer head, chest and abdominal trauma.

Back seat passengers also can become human projectiles during a crash, injuring or even killing others in the vehicle, state officials ahve said.

Beginning Jan. 1, Illinois requires all passengers, including previously exempt back seat riders age 18 and older, to buckle up.

The bill was signed into law during the summer. It allows police officers to stop a car if they spot an unbuckled rider. Fines start at $25 but can be more, depending on court costs.

While most people killed in automobile accidents are front seat riders, 64 percent of back seat passengers killed are not wearing seat belts.

Recycling electronics

In clearing the post-Christmas clutter, do not throw out the old electronic gadgets with the wrappings.

As of Jan. 1, that is against the law.

According to the state’s new and improved Electronic Recycling and Reuse Act, it is now illegal to throw them out and illegal for landfills to accept them.

Not only are consumers required to recycle TVs, computers, video games and much more, but so are manufacturers.

According to the Environmental Law and Policy Center, the increasingly short lifespan of electronic items makes them the fastest-growing waste. They contain a lot of toxic materials — lead, mercury, arsenic, cadmium — but also a lot of reusable materials — copper, gold, plastic, glass, circuit chips.

If recycling is “convenient,” people will do it, said Melville Nickerson, an ELPC attorney.

The Illinois Environmental Protection Agency operates permanent collection sites where anyone can drop off their unwanted electronic items.

Some stores will accept old equipment when a new item is purchased.

The amended law mandates more items be recycled — more than any other state requires — such as VCRs, DVD players, keyboards, computer mice, fax machines, scanners, video game consoles and digital converter boxes.

The law also sets the highest recycling goals for manufacturers.

In 2012, they must recycle — by weight — 40 percent of what they sold in 2010. By 2013, the goal increases to 50 percent.

That means e-recycling will increase from 28 million pounds in 2011 to more than 50 million in 2012.

Fighting fake pot

Fake pot isn’t normally hard to find. It’s not kept in some back room.

Tobacco shops usually put synthetic marijuana on display.

All of this was legal across Illinois, until Jan. 1. Springfield lawmakers have joined a national movement to get the stuff off store shelves about three years after it first appeared in the United States.

Sold under several names, synthetic marijuana is most commonly labeled “K2” or “Spice.” It’s usually sold as potpourri or incense and “not for human consumption.” The pouches contain plant material laced with chemicals, drug officials said, meant to simulate the effects of marijuana, offering a “legal high.”

The White House Office of National Drug Control Policy reports poison control centers took 5,741 synthetic-marijuana-related calls in the first 10 months of 2011. That’s nearly twice the 2,915 calls in all of 2010.

The Illinois Poison Center said it took in 306 synthetic marijuana calls from Chicago and its suburbs in 2011, more than a four-fold increase from last year.

Fake pot can cause everything from psychotic episodes to hallucinations to seizures to nausea and vomiting, according to the White House and public health departments across the country.

‘Andrea’s Law’

One of the new measures is “Andrea’s Law,” named after Andrea Will of Batavia who was killed by her former boyfriend at Eastern Illinois University.

Andrea’s Law requires that people convicted of first-degree murder must be added to a new first-degree murder database, similar to the sex offender registry, when they are released from prison or any other facility. The public database would include names, addresses, employment places, schools attended and photos for offenders for up to 10 years after their release from prison.

Andrea Will was a freshman at Eastern Illinois University in 1998 when she was murdered by her former boyfriend, Justin Boulay of St. Charles.

Andrea’s mother, Patty Rosenberg, began her campaign for Andrea’s Law after learning Boulay was being released from prison in November 2010, after serving only half of a 24-year sentence for first-degree murder. The law quickly made its way through the legislature and was signed by Gov. Pat Quinn last summer.

Among other laws that have now taken effect in the state:

• Convicted sex offenders who are employed at or attend a college or university must register with campus public safety.

• School boards can suspend or expel a student who makes an explicit threat on a website against another student or school employees.

• People with an order of protection issued against them must surrender their Firearm Owners Identification Card until the order is lifted. Anyone convicted of domestic battery is ineligible to obtain or keep an FOID card.

• Motorists stopped at a red light may proceed through the light if it fails to change to green after a reasonable length of time.

• Animal-control facilities scanning a lost pet for a microchip also must look for other common forms of identification, including tattoos and ID tags.

• Antique vehicle owners have unrestricted use of highways from April 1 through Oct. 31 if they obtain an expanded-use registration.

Time to Clean Up Your ONLINE Profile

For those of you who are about to graduate, those seeking employment and even those of you beginning the process of applying to other colleges to continue your education, review and clean up your online profile. More importantly, begin thinking about what you post, photos, comments, status updates. Employers in areas far less security conscious than those we prepare you for will do background checks and comb through your online existence. Our career fields most certainly do this and you won't appreciate having an opportunity evaporate because you had half naked drunk pictures of yourself from the "best night ever" posted on Facebook or you posted your play by play status update of some vandalism spree you and your friends went on one Saturday nights. I was on the other end of a phone call when a very good job offer to a post-degree program Paralegal student was rescinded because she was apparently a picture posting party girl. I also had the displeasure of receiving a call from the Chief of a local police department when the person who had been a model student and tested well enough to be first on that department's list of applicants was to be eliminated from consideration because he was tagged in a video one of his buddies posted after a night of petty vandalism, drinking in a vehicle and references to "smoking weed".

Cameras are everywhere, things you post on the web travel at the speed of light and become known by more people than you might ever imagine. Think about what your career objectives are, what you say or do and especially what you say or do online. If you wouldn't say it or do it in front of your Grandmother, don't say or do it online. If it's illegal for you to do, don't do it. Show character, maturity and most important, some forethought and common sense.

Thankfully there was no Internet, Facebook or Youtube to record and memorialize the transgressions of my and my buddies youth. But those things exist for you and that information can follow you for a long time. Act accordingly and most important, review and clean up your profile where needed.

Students from years ago will remember my crystal ball view on licensing of Paralegals. The update of those discussions include not only the realities of a now established profession but the complexities and challenges of current state budgets as well. Licensing Paralegals makes sense both from a public policy point of view in that Paralegals are performing complex legal work, many times largely unsupervised or less supervised than they should be allowed and there are no standards for who is or can be tagged a "Paralegal". California has had a "Certification" statute for years. Now New York has a Licensing bill out there for consideration, see:

Remember the discussion of old? Paralegal regulation will take hold on one coast or another and then move across the country. Pay attention. You leave here a Paralegal and this sort of thing will only further validate your existence as a Paralegal, preventing others who have not sought formal education or had sufficient training from being called a Paralegal.

Bradley University is accepting applications for the position of University Police Officer.
Bradley University Police Officers develop partnerships within and outside the University community and maintain the security and safety of students, faculty, staff, and visitors and safeguard the property of the University and its community. Police Officers are generally assigned to patrol the campus and surrounding areas by car, bike or on foot, making routine checks of campus and residential areas, looking for hazardous, unusual or suspicious conditions requiring police action or assistance. They assist the injured, elderly and disabled; administer first aid; direct and control campus and surrounding area traffic; investigate suspicious persons and vehicles and secure accident, crime and disaster scenes. University Officers will interact on a regular basis with federal, state and municipal law enforcement agencies.

Police duties involve protection of life and property through the enforcement of laws and ordinances and general police assignments including patrol, preliminary complaint and criminal investigation, traffic control and accident investigation. University Officers identify and apprehend offenders; conduct interviews and interrogations; locate witnesses; seize contraband; conduct warrant checks; perform surveillance; search persons and places; attend court and testify in the trial process and prepare written reports on assigned tasks.

Duties may involve an element of personal danger and require University Police Officers to act without direct supervision and exercise independent judgment in emergency situations. Bradley’s Officers respond to calls and complaints involving fire, automobile accidents, domestic and neighborhood disturbances, assaults, robberies and any other felonies or misdemeanors. They conduct premise checks; secure and unlocking doors as necessary and police special events as assigned.

Minimum Qualifications

· U.S. Citizen
· Twenty-one (21) years of age.
· High school degree/completion or equivalent. Associate degree or hours toward Bachelor degree preferred.
· Illinois resident; valid drivers license; record free of three moving violation convictions in a 12-month period.
· Personal history free of criminal convictions that legally precludes employment in a position of trust.
· Satisfactory results from background investigation.
· Not prohibited by any court action and/or state or federal statute from carrying a firearm.
· Excellent verbal, written and interpersonal communication skills.
· Ability to satisfactorily complete written exercises to evaluate ability to perform successfully in the

Workout Plans and Thoughts for Summer Criminal Justice Interns

The following is a series of workout plans offered in a weekly/5 workout per week format. Although each week’s worth of workouts are designed or planned with a particular purpose and specifically with preparation for the Power Test in mind, you can mix and match, use or not use any of this and the real motivation is to provide some ideas for jump starting our students toward better preparation for the physical agility expectations for both being successful in the hiring process and staying in shape once on the job. None of these workouts should take more than 45 minutes out of your day. You will note that while we suggest some use of weights, these aren’t “pound” weight type workouts. These professions require that you develop and maintain a balance of strength, flexibility, speed and endurance. These workouts are based in part on the Crossfit http://www.crossfit.com/ philosophy and in part on our experience teaching physical conditioning in the college and academy settings. The goal is to complete 5 workouts in a week, be sure to schedule two “rest” days, one suggested mid way and one at the end of your week. And always properly feed, rest and listen to your body. On listening to your body, be honest about the difference between being tired or sore and being injured. Tired and sore will be part of the equation initially and feeding and resting your body properly will address most of “tired and sore”.

Be sure to stretch after each workout, especially your runs. Developing and maintaining flexibility is key to avoiding injury both during workouts as well as from some of the physical demands of these careers. Stretching should be the highlight of your workout, it’s when your body begins to recover and it is the “feel” good part of the workout.

Final thought before introducing 4 weeks worth of workout opportunities. Staying fit, flexible and healthy is essential to gaining access to and finding success in CRJ careers. Start slow but be committed, watch the sugar and soda intake, cut back on the ciggies, the alcohol and watch what you eat. Workout 5: Yoga. Don't laugh, part of the Power Test requires flexibility. One of the best ways to gain and maintain flexibility is learn and incorporate some basic Yoga poses. Workout 1: Run 1 mile, 100 pushups, 100 sit ups, 100 squats (no weights on the squats this week but get deep and hold your form) and stretch.

Workout 2: Run 1.25 miles, 125 pushups, 125 sit ups, 125 squats and stretch.

Workout 3: Run 1.5 miles, 150 pushups, 150 sit ups, 150 squats and stretch.

Workout 4: Full Tar Heel medicine ball workout (see Week 1 post), 20 push-ups between each set

Workout 5: Run 3-5 Miles like someone is chasing you and then 20 minutes of Yoga stretches

Week 4, Bring It On

Workout 1: Run 800 warmup, 100, 200, 300, 400, 300, 200, 100 sprints, 800 cool down and stretch

Now continue moving forward. Develop your own workout plans and strategies. As with your studies, schedule time to work out, eat right, get proper rest and be committed to making this a part of your pre and post employment life as a Criminal Justice professional

Several hundred Law Enforcement, Criminal Justice and Paralegal grads of Illinois Central College have had the opportunity to enjoy classes presented by Professor John Wyant these past 17 years.

John came to Illinois Central College after a career that began in education in Ohio where he was among other things an Assistant Principal. He switched to a law enforcement career at some point and spent the next 20 years as a police officer and various other law enforcement related functions before retiring as the Director of a regional police training academy. He had added a law degree to his prior graduate degree shortly before retirement and a short time later he joined the faculty at Illinois Central College where he has taught Criminal Justice courses and served as the Director of the Paralegal Programs for a period of time. It would be easier to list the courses John has not taught than to list those he has taught and regardless of the topic, course or content, his students have consistently found him to be one of the better instructors they have had to pleasure to spend a semester with at Illinois Central College or any other college or university.

Professor Wyant hasn’t decided what he’ll do in the next chapter of his life, though we don’t see him sitting still for long. Those who know him will understand that his humble nature dictates he doesn’t want gifts, accolades or much attention drawn to his retirement or years of service to the students of Illinois Central College. I am participating again this year in the St. Jude Tri-County Run to support St. Jude Children's Research Hospital. This year I will be running for a several local kids, Ryan Hiserote, a son of one of our ICC grads continues to be on my list of St. Jude kids. Ryan is doing great but still receiving care at St. Jude in Memphis and the Midwest Affiliate locally. Because the developments and progress made at St. Jude seems to carry over in treatment and approaches taken for adults as well, I add adult cancer patients to my "motivation" and prayer list as well. I keep these kids and adults in my thoughts and prayers and they help motivate me to get out there and run for the kids of St. Jude. This year I am running for one of my favorite graduates and a long time St. Jude supporter, John Fairley. John is not doing well, suffering from a brain tumor. I will proudly log as many miles as I can for John and the kids of St. Jude.

As the current term comes to a close I wanted to say thank you to the students in my two Admin law course sections, my Civil Litigation course, Business Organizations, Evidence, Legal Research One and the Medical Terminology for Paralelgals I was able to present with Dr. Jean Holmes. Each of these courses is very different from the other and it is sometimes a challenge to present this wide range of courses. It would be impossible if I didn't have students who come prepared to put in the time and effort necessary to master the content and skills presented in each such course. The law being an ever changing and jealous mistress, I end up learning much from the efforts of my students each semester and this fall was no exception. To those moving on to your chosen careers, be prosperous and safe. To those moving on to other educational opportunities, be studious. I hope all of you stay in touch and keep us informed of your future endeavors. For those who are returning for the spring semester, finish this term strong and then enjoy the semester break. Come back ready to work again through the spring semester.

We had this discussion in class today and then student Lori Myers forwarded the article linked below. Keep in mind that, to a small degree, lawyers are wired to want everything under the sun. That said, author Kim Walker drives home two of the principles we discussed today stateing:

Two points I want to drive home are that you need to take control of your skills and you are responsible for learning all the new tricks of the trade. The second is no one is good at everything. Work on your weak skills, but it's OK to ask for help from co-workers that do something better than you do.

Illinois Rules of Evidence are No Longer "Proposed"

The Illinois Supreme Court has approved the Illinois Rules of Evidence in codified form aimed at expediting the trial process and improving the administration of justice in Illinois courts. The Illinois Rules of Evidence, as they will be known, was a primary goal of Chief Justice Thomas R. Fitzgerald and represents a nearly two-year effort by a Special Supreme Court Committee. These rules become effective in Illinois court rooms January 1st, 2011.

The Armadillo 2 Visits Criminal Justice Students at the North Campus

The Peoria Police Department Nuisance Property Surveillance Vehicle, the “Armadillo II” visited the ICC North campus today. The Armadillo I and II are refurbished armored trucks outfitted with state of the art surveillance systems. An “Armadillo” can be parked in front of drug houses or nuisance properties where activity plagues the quality-of-life of surrounding neighbors.

The Peoria Police Department created the Nuisance Abatement Department and placed ICC Law Enforcement grad Officer Beth Hermacinski in charge of managing the Armadillos and other nuisance abatement initiatives.

Officer Hermancinski, shown above, provided current ICC students with not only a great overview of the Armadillo and the concept of nuisance abatement, she also provided invaluable career advice and insight.

Professor Wyant, Professor White, Professor Higgins and Program Coordinator Weghorst were very appreciative of the the opportunity to provide to our students with this valuable educational experience.

Sustainability Checklists for Lawyers, Law Firms and Corporate Law Departments

The course Globalization and Sustainability for the Practice of Law was recently presented in a 4 week, online format through the American Bar Association approved Paralegal programs at Illinois Central College.

Using the Oregon Lawyers for a Sustainable Future Checklist for Sustainable practices in a Law Office as a template, our students were asked to develop their own version of a sustainability checklist, one that would potentially be used by a current employer, internship host or in general by any central Illinois lawyer, law firm or corporate law department seeking to facilitate more sustainable practices in day to day office operations.

We offer the attached document as a resource we hope local lawyers, law firms and corporate law departments will consider adopting in whole or in part into their daily business operations. At the very least, we hope the seeds planted by this course and attached documents help promote thoughts and discussion about more sustainable business practices in the central Illinois legal community.

Paralegals are NOT Overhead!

From the American Association for Paralegal Education list serv:

A newspaper ad for a law firm in another state apparently attempting to drum up firm business, reads:

"Most law firm charge between $50 to $100 per hour for time spent by a paralegal on your case, and typically part of that time includes purely secretarial tasks.

At the *********Law Firm, we do not charge for paralegal time. We consider it to be part of our overhead, not yours. We charge only for the time spent on your case by qualified
attorneys......"

This is both an example of why Law Office Management courses should be required in law school and a woefully misguided lawyer or law firm. A well trained and properly utilized Paralegal is able to assist the lawyer in providing very effective, cost efficient legal services for the client while at the same time contributing to the income of the law firm and reducing the firms overhead.
